(Querist) 09 January 2017 This query is : Resolved 
a company registerd under companies act given a cheque signed by managing director and bounced.the complaint filed a case u/s 138 of ni act.making the company and the managing director as an accused.
but the managing director send a person authorising him as on his behalf.
is it correct?
kindkly give the suitable answer in this regard .

Yes, he can send some other person if he is not capable of remaining present before the court.

if the person who signed on behalf of the company is left the company at the time of filing the case aganist the company then what is the fate of the case .please let me know as i am the complainent filing the case u/s138 of ni act.
