Dear sirs
I have one show room size 22 ft x 44 ft i.e.924 sq ft. I sold an portion of 7.5 ft by 20 ft to my daughter by Registered sale deed 4 Years back. now the groundfloor is less than 900 sq ft which is in my name .
as per Rajasthan nagar vikas Tax amendment
if a property is less than 900 sq ft no Nagarvikas Tax is applicable.
Nagarparishad is not considering our sale
made to daughter and want to take Tax on whole premises saying this sell is inyour books and you have to get it amended in our parishad They are saying aply for division and after approval accordingly action will be made . since the plot was taken for 99 years lease . kindly suggest what to d0 to solve the problem

The act and conduct of Nagar Parishad is objectionable so you may file an appeal before the collector of your area and may get the order of parishad set aside.

My answer based on that :-
Nagarparishad Objection is:-
1.Lease deed (There may be many terms and conditions)
2.No amendment in parishad
@Author,
before going to appeal before the collector, you should check terms and conditions of lease deed?
Is sale deed permissbale?
and also check what is rules and regulations of parishad after getting sale deed, to register parishad or not?
or suo-motu parishad register?

There are points to be considered by you.Rights conferred upon you are as lessee then find out how you can sale a leased right
,at best you can create sub lease that too with prior permission.
Was it convertible as free hold under terms of lease???
If yes!Did you got it converted as free hold before selling it to your daughter???
One can adopt a sham transaction in favor of his daughter just to avoid or evade some taxation.
Consider the merit of your case in the light of points shown above and accordingly proceed.

here is Mr.Prabhakar 'Singh' not 'RAO'.
