Name change procedure in India

Generally, for name change of a person the procedure requires filing of an application before the executive/ 1st class magistrate within the jurisdiction of the place of domicile of the person desirous of name change.Every one knows and follows this procedure. But can any body answer where this procedure is laid down. The civil procedure code talks about only affidavit under section 139 of the code.
