Ncr u/s 507

Guest (Querist) 16 February 2014 This query is : Resolved
Dear Sirs,

I have lodged a NC at local police station in the presence of the opposite party. Police has issue me a copy of NCR lodged under section 507 of IPC.

How I have to proceed further in the matter? Is it compulsory for me to make an application to the magistrate? If yes, what is time limit? If not, what is the importance and time validity of said NCR issued by police?

Waiting for your reply.

Thanks in advance.
Advocate M.Bhadra (Expert) 16 February 2014
Charge under Sec.507 IPC is non-cognizable and bailable,so if you do not like to go further then no need to proceed. On the other hand if you like to proceed then you can file an application to the Magistrate Court u/sec.155(2) Cr.P.C. to investigate again by the police or you can file a case u/sec.200 Cr.P.C.as a private complaint.

Agree, Magistrate has to be approached for proceeding further in the matter.

Wait for the police to initiate appropriate legal action on your complaint, if they do not handle it effectively then you may approach a magistrate court for further action.
