NEED ADVICE ON MARRIAGE WITH FOREIGNER

Querist : Anonymous (Querist) 08 September 2010 This query is : Resolved
Mine is a ceremonial unregistered marriage between Indian Hindu and Japanese Shinto. I have filed for annulment in Family court of Bangalore because her religion does not come under Hindu marriage Act 1955. My wife has left India and will not appear in court for her statement. Exparte hearing will commence as court has served summons and newspaper ads for the same. Could you please advice how to argue for annulment because I cannot find any evidence (as in her passport copies or registration papers) to prove her religion. For japanese both buddhism (as governed by Hindu marriage act) and shintoism (not governed) prevails.

Did your wife convert her religion to Shinto from Buddhism after marriage?
Did you know her religion as Shinto before marriage? Did you consummate your marriage after you came to know of this fact that she belongs to Shinto religion?

Before and during marriage she told me she told me she follows buddha but recently disclosed that its fraud and they actually are shinto. Actually she is not very religious and hardly went to any shrine so i never bothered. I have given this as argument in my petition and also I have a screenshot of her Orkut profile and picture where she put her religion as shinto. Im not sure if judge will be accepting that as online profiles are can be created by anybody. So what is the reasonable argument ?
