Respected Experts, One of my friends Fell down from Running Bus(Govt MTC) on 14.05.11 night 9.50 pm. Before he getting in the bus the Driver suddenly took the bus so he fell down from the bus the back tyre of the bus runover on his right leg. He got fracture injury he was hopitalised In G.H Chennai. Police enquired him at G.H. The Accident taken place at Thirumahisai. It comes under Vellavedu Police Station Controll. Today (31.05.11) I went to Vellavedu Police station & asked the Writter he checked up In Hospital report record. The accident information was there in the Hospital record. But They Didn’t put F.I.R. till now. Is it Legally Acceptable? Please advice.

you can claim compensation from Govt under the provisions of the Motor Vehicles Act. The hospital record besides oral evidence would be enough.

If the police is not lodging the FIR send it to the office of SP concern by registered post and keep a copy safe for further action. 2)file a claim Under Motor Vehicle Act, against the owner and driver of bus without any thinking of insurance ,as it their concern not yours. keep all medical records as evidence to be produced in the case,i am sure your friend has good claim to be awarded.

It is not the question of insurance of the vehicle, it is the question of claim of compensation from the owner. You can proceed against the owners (Government and the driver of the bus). You should not be concerned with the matter whether the claim is met by the owner himself or the insurance company.
