Need help on m.o.u

i m working in pvt merine service company. As we have worker's union the M.O.U. was signed between WORKER'S UNION and The COMPANY MANAGEMENT.

In agreement both sides agreed on DIWALI BONUS to be paid on GROSS salary of workers. agreement was signed last year. But on the eve of diwali management refusing to pay DIWALI BONUS as per agreement. Pls help us on this situation.

Rajendra K Goyal sir thx for reply, we have sent a representation today afternoon. but management quickly responded to it with nigative remark. they refuse to pay bonus as per M.O.U, instead they told us that bonus will be distributed on basis of worker's BASIC + DA only.

So what should be our next step? pls guid me.

Workers union which signed the agreement with the Management may consider three options: 1. Launch an agitation in the form of demonstrations before the Head Office of the employer and submit a memorandum of demands. 2. If the Management does not respond positively, consider resorting to strike. 3. Also consider raising an industrial dispute in the labor court.

The workers union which signed the MOU may consider the following steps: 1. Organise demonstrations before the HO of the Employer and submit memorandum to the MD or the chairman of the Company as the case may be. 2. If the Management does not respond positively organize strike after issuing the requisite notice of strike.3. Also consider raising an industrial dispute before the labor court.
