Need help regarding this issue.

(Querist) 22 December 2010 This query is : Resolved 
I have a credit card from ICICI whose outstanding balance is 73000 and the settlement amount is put across as 41000.Currently i don't have a job and not in the state to make any payments.person calls and says that he is calling from police station and says that a non bailable warrant has been issues on my name.Says to speak to the lawyer.Spoken with the bank and informed them about my present financial state and that i need time to repay but they are calling me to the bank along with the cheque book.I'm completely bankrupt now.I have received a court notice on my mail on the 8th of DEC which gave me 7days (15th DEC) to resolve it. Kindly please advice.

receipt of court notice indicates that already legal proceedings has been initiated. Do contact an advocate and show the court notice so that he can findout about the stage of proceedings and help you out. Do not issue any furter cheques to the bankers. If they are still harassing you with threatening phone calls do lodge a police complaint with the help of your advocate.

i agree with Mr Srinivas

it is good that you received Court Notice from Lok Adalath / or /Summons from Court in suit filed by bank - you can represent the same before the Court and get a installment Decree - take services of local advocate in this matter!

Yes but chek whether any case at all is filed as in several states including west bengal there is no system for sending summons through e-mail.

Please check with the concerned court regarding the status of a so called case. I dont think there will be a case against you. The collection agents are threatening you.

Neither the CPC nor the CRPC provide for service of summons by e. mail. However pl check up with the court mentioned in the e mail whether any suit is filed and take further steps as suggested by the learned experts above. It is possible that a scanned copy of the summons is sent to u and the hard copy may be served on u in due course by Regd post or through bailif.
