need help under section12(A)domestic violence

(Querist) 28 March 2011 This query is : Resolved
Respected sir ,

in continuation of my last query.

as per process first jmfc magistrate first has to decide that whether domestic violence has occured and then going for interim arguement

or first directly going for interim order then it will be decided that domestic violence has occured?

in my case it is directly interim arguement and not even a single word before that?

kind suggestion

thanks in advance

The court will have to be satisfied, albeit prima facie, about commission of domestic violence in absence of which no order-interim or final, could be passed.
