Neighbour constructed wall in our property

Respected sir,
Our is a small plot of land in kerala,dist ernakulam, in that the neighbour has constructed a wall extending the area of his to our plot. instead of straight wall the neighbour made a curved wall occupying our land in to theirs. While we have noted in our plan that the wall is straight between us and them. Can anyone help how to proceed in this matter.

If there is any encroachment, it should be objected by the aggrieved party at once.
Therefore, you are advised to file suit for mandatory injunction to demolish the wall along with other reliefs, if required, such as Declaration of title and recovery of possession of encroached area, before the Jurisdictional Civil Court with an aid of advocate at the earliest.

Send legal notice and file case in local court if no positive response to legal notice received.

First of all confirm the encroachment by measuring your plinth are with the help of revenue authorities and assess the area encroached, issue him a notice to vacate the encroached portion of your property, if he is not responding then you may approach appropriate court of law for relief and remedy. I will get the surveyor report, and also check with the municipality if at all any thing is there in construction of the wall by neighbour.
