Ni 138, 313 statement

Sirs;

In 313 stmnt accused has averred:

"Receipt of part payment amounts to waiver of right to seek action of the higher value cheque"

Is this maintainable in law or is there a citation to that effect? Pls help and enlighten me. I am worried about this. Regards:

if cheque has been issued for say RS 10 lakhs and after dishonour accused makes payment of rs 1 lakh then how can complaint of rs 10 lakh be presented .

Ok. Chq bounce was for 85 laks. Got back 60 after sending notice. Fighting for rs 25 laks plus promised interest...

you have to file summary suit for recovery of money with interest .
