Non appearance of complainant in appeal does not affect the merit of case.court has to decide appeal on merits.

The appeal is appellant's case, which has to be represented properly by his counsel, in the event of default of counsel for appellant, the case may not be properly handled becoming fatal to the appeal. The respondent/complainant or his counsel's presence will not make any difference to the merits of the appeal.

The appeal will be disposed on merits without any objection.
