Ni act summon

Sir kindly help me the cheque is bounced the the person issue the check stays in pune now the summon has been issued to that person but it is through post.i want to know if it is outside the jurisdiction of Mumbai than its should be issued by magistrate court to the court having that jurisdiction and copy of that summons shall be taken as a recod but here the advocate is sending summon through registered post what can be done it is right or we shall ask the lawyer to do the process issue via channel of court thanks for guidance

The lawyer will be following the procedures being followed by local court.
If your lawyer is not cooperating then you can change the lawyer and proceed through another lawyer

Procedure adopting by your lawyer is correct and not wrong .Summons can also be sent to accused person by Regd post and inspite of having received summons,accused does not appear then court issue bailable warrant/arrest warrant.

The court is sending the summon through post. If the accused do not attend the court the court will send the summons by RP.

The first instance, the summons will be served by the Court through the designated police personnel. If the service is not properly served, the complainant has option for seeking personal summons.
