No witness and complainnant is presented after 3 years

Dear Sir,

A policeman had registered a falls case on me in Oct 2013 and court has issued warrant to his witnesses and him also to present for witness but for the last three years neither witness nor complainant.

I request you kindly help me and guide me how this case can be dismissed and i can be discharged if witness and complainant is not coming after issued NBW warrant.

Kindly advise me with section and judgement if any so that i could not be suffered if complainant also not coming for the last three years.

Your lawyer has to pressurize the court to close the evidence of the prosecution. The court has to take into consideration the right of freedom of the accused also and protracted trial without having his fault is definitely is denial of his constitutional rights hence court should be prayed accordingly.

Once evidence is closed, you shall get the desired relief.

Academic query of a law student. More so, asking for section and judgement, in itself proves that the same are desired to solve academic exercise.

However, if there is any truth in your description, better get your case related documents examined by some expert to guide you appropriately, if your own lawyer is not helpful to get your case contested properly.
