Noc for the sale of flat

Its been a little over 15 days we have given application for NOC for the sale of the flat but the secretary has not yet given us any reply on the quantry he is demanding a letter from us stating that " we intend to sell the flat we have no dues towards the society and that the society can take any legal action against us it deems fit... how can we give such a letter to the society allow the society to take any legal action against us for what? This was told to us by one of the managing committee members I suppose on instructions of the Secretary the buyer is insisting on an NOC since he has taken a preapproved home loan what should I do how do I convince them to give me the NOC under the bye laws I am under no obligation to give them any letter they are under an obligation to tell me why they are not giving the NOC to me.. kindly advice..

you are correct . once you have made application in writing for issue of NOC society has to revert back in writing . you cna give a letter that all society outgoings have been paid till date and that there are no society dues pending

It shall be better for you if you write a letter in the following language
"I intend to sale my flat no. ......and I have already cleared all dues of the society and even if any legal dues are found pending, I shall be liable to make its deficiency and the society shall have a right to take legal action to recover that legal dues against me".
I think this shall suffice.
