This query is : Resolved
I have let out a building whose legal owner was my father who has expired one month ago. My tenant is asking for an NOC from my sibling since no transfer of right on that building is made in my name. Me, my mother and 4 sibling are the legal heirs of my fathers property and the partition is yet to be done. So please help me with a NoC format so that i can provide my tenant.

State facts. Why NOC asked.Does the tenant pay rent? Or wants to renew the period.

Sir, the tenant is using this rental address as his registered office for his business. So for registration, the rental agreement and property tax receipt is asking. In rent agreement, the lessor is one of the son of the deceased owner, but the property tax receipt is in the name of the deceased one. So to resolve this mismatch the tenant is asked to provide the NOC
from the all other legal heirs of this deceased person.

Other legal heirs may give an affidavit that they have no objection if the premises is given on rent by you.
The address as Registered office should be permitted only if given for commercial purpose and situated in commercial area.
It would be better to consult some local lawyer and get the NOC / Affidavit drafted / obtain suggestion for alternate steps to be taken.

To me, is your building in the residential area or commercial area? You give it on rent but it will be used for commercial purposes. In the circumstances, your property tax will be levied treating it as commercial property.

1. IF professionals /lawyers indulge in "FREE" services like giving out Judgements, Advises, detailed Answers, Opinions, DRAFT of Deeds, MOU, Agreements, Petitions, etc...., THEN they will have to sit outside a Temple /Masjid /Church /Railway station, for their own livelihood.
2. Coordinate with a local experienced Lawyer specializing in Property Matters, for your requirements.

Show the rent agreement, which is stated to have been executed by deceased, to a local prudent lawyer for appreciation of facts/ documents, professional advise and necessary proceeding.
