2. It is not possible for Society to confirm whether Applicants are the Nominee and/Nominees of the Auction Purchaser Shri Majeed Ahmed Oomerbhoy which can be verified from High Court Order dated 9th January 2009 and Undated Consent Minutes of Order filed on 8th March 2010 at time of matter appeared as Speaking to the Minutes. The said Consent Minutes of Order does not have name or names of any nominee or nominees. In law without name Nomination is not allowed. The said undated Minutes of Consent Terms signed by one Nadeem Majeed Oomerbhoy alleged to be Constituted Attorney in law which is not permissible as on the day the Auction Purchaser Shri Majeed Ahmed Oomerbhoy was alive as the said Auction Purchaser Shri Majeed Ahmed Oomerbhoy expired on 11th May 2010 only which proves by Minutes of Meetings held before the Learned Court Receiver on 11th November 2016 in which Advocate Ms. Kanchan Pandare informed “that she will submit the names of the purchaser to be mentioned in respect of three flats. She is requested to give the same in writing so that drafts of conveyance will be finalized and Minutes of Meetings held before the Learned Court Receiver on 9th December 2016 in which Advocate Ms. Kanchan Pandare Advocate i/b Mr. Shailesh Thakkar, Advocate for the flat purchaser wherein names of purchasers are mentioned. On the request, plaintiff includes name of parties, signature of M/s. Oomerbhoy Investments & Ors. on the said letter. Accordingly, same are taken on record. Hence till now name of the nominee was not decided and blank name is not allowed in co-operative law as well also in general law
