Non ancestral property of father

(Querist) 28 December 2011 This query is : Resolved 
My father has non ancestral agriculture land in our village. We are two brothers. my father want to transfer the property to a lower cast person of the village, who is not a legal hier of the said property. My father want to transfer the property by will, gift, sale or any other mode. Can any remedy is available for us. What can my mother do in this matter to save the property?

If it is his self acquired property then you could do nothing to stop him from transferring the same.
He being your father should be respected for whatever decisions he takes.

If you are now majors then concentrate how to build your own property than eyeing upon his property.

You cannot claim anything from the self earned property of your father. He has the right to do whatever he wants to do with the said property.

If it is non ancestral agriculture land,that means it is self acquired by your father.So being the case you can not stop him doing any thing.Your mother can however file a suit for charge of maintenance over these properties till her life by a suit but she too can not check him from alienation.
