Not provide esi benefit

Dear Sir, I was working in the mnc company as contract employee.The company did not provide me ESI benefit. I was covered under ESI act .my salary was Rs 13500. Due to non availabilty of esi ,i admitted my father to private hospital for heart surgery. Pls let us know can i claim the amount to the company through filing a case in labour court.As there was the mistake of the company
