Hi,
I have some query regarding notice period and salary.
I worked in IT service company Parent Company in US. I joined on 5th Dec 2011 on that time I am not received Offer of Appointment letter,I also informed many time but they ignore this then, I mail to company on 26th March I am resign from 1st April, after my resignation mail next day they give me xerox copy of Offer of Appointment letter with out mention notice period or I am on probation or confirmed employee back dated 5th dec 2011. Now they told me I have to serve 1 month notice period any they hold my March month salary. So is that possible ? Please guide me for this issue.

if you have addressed mails to company that you have not received appointment letter then the company is at fault .
send a detailed letter mentioning that after resignation submitted company has given back dated letter terms and conditions mentioned therein are not accpetable .
request them to pay your march dues

I received xerox of Offer of Appointment letter but in that letter company rules not mention. After my resignation they told me We tell at time of interview, this is company law,and so..... I call my boss today around at 12:00 in early morning from my duty . he says we have to discuss on this matter and informed you in two days. Then I send him detail mail about all issue and left from my duty (my duty time is 8:00pm to 5:00am). I send them resignation on 26th but still on 29th midnight I am not received any satisfied answer from any one. Can they hold my March Salary or I am legally eligible to get March salary bcoz I serve full month. What step I should take for this issue to resolve ?

Thanks,
I send them mail as per you mention. Now my NJ US boss says you have to inform me if you not received appointment letter at time of employment but I inform couple of time my Tech Lead and Administration officer here in Ahmadabad office where I worked. Now I received mail from from my us boss stated that " you will be compensated for the appropriate amount for you efforts in March as per company policy" .

I advise you to complete one month, as demanded by the Co.
No employee can just leave without notice the same day.
Co. have to arrange to replace you.
U r lucky, they don't demand 3 month's notice.
As co. ready to compensate for march, it shd close the chapter.

Minimum one month's notice is quite essential even if there is no mention of the notice period in the terms of appointment.
