Notice to nri

(Querist) 28 June 2015 This query is : Resolved
My Uncle is a NRI in Canada and he had signed a sale agreement with a buyer in India. His relative informed him that the buyer has filed a civil law against him for money recovery. It has been over 2 months and my Uncle in Canada has not received any notice or summon.

Does my uncle need to do anything or wait till he receives any notice or summon.

Please advice.

If he has given his overseas address alone in the agreement, let him wait till he gets the notice. If he has given a local address in the agreement, the notice would have been sent to that address and returned. Check the said aspect also. If a local address is given and a notice is issued, then let him give instructions to a lawyer and give a POA to someone to defend the case.

Consult a local lawyer and have proper followup in the case. You have not mentioned what address your uncle has mentioned in the agreement.
