Hello experts,
I am currently located in Mumbai and I need to file a written statement for MACT case in Delhi. My lawyer have advised me to send signed written statement with a affidavit attested by oath commisioner. I am currently in navi mumbai and Thane court is nearby. Is it mandatory to have submit a written statement to court with affidavit attested by Oath commisioner?
Could anybody please help me in locating oath commisioner and also explain me the procedure that I should follow to get the affidavit signed from him. My lawyer have prepared a written statement and also created required affidavit.(Please note that my lawyer is in Delhi).

Look please i am from UP then can not lend you any personal support.If desired you may
send a private message to Mr.Ajay Sethi expert at this forum from Mumbai.
However you are not in a big problem.An affidavit is required to be filed in your case in Delhi,for which you need not be confused, that is an ordinary course.
As you state you are near Thane Court ,just carry Your ID and visit there and locate an oath commissioner,sign the affidavit every page in his presence and get it verified and sealed by him,there might be some duty as stamp of 10/+ may be payable and he shall also charge fees,at our it hardly cost a hundred in all,how much there,i do not know??
The advise to carry ID is that he may not get hesitant in acknowledging your personality.
Having this rough idea will keep you from any unreasonable charge.
One more reminder ,after getting the verification by oath commissioner get photo copy of all of written statement and affidavit pages safe with you before posting them to your lawyer at Delhi.

sir simply ask your lawyer handling the accident case you help u out in getting the commissioner signature of the affidavit. this is practical tips .

1. I completely agree with the very neat and clear guidance of Mr. Prabhakar.
2. I am little bit unhappy with the querist for when his lawyer advised him to send signed written statement with a affidavit attested by oath commisioner, he is asking "Is it mandatory to have submit a written statement to court with affidavit attested by Oath commisioner?"

Thank you all expert for providing quick help and suggestions specially Mr Prabhakar.
Mr. Ramchandran actually I am not doubting my lawyer but as I am totally layman and don't know much about law so just wanted to clear my doubt since for me finding a Oath commisioner in some court is very difficult, infact I tried it one day but was not able to locate him and I don't want to pay any fancy charges for that.

Dear Anonymous,
I agree that you may be a layman and I have no issues about your asking as to where you can find a Oath commissioner. But, your telling that your lawyer has advised ... and then asking "whether it is mandatory" is a little bit too odd.

Affidavit may be affirmed before a Notary in Mumbai. It will be accepted in Delhi.
