On my probation period no pf deduction, now hr telling that reason to refuse my gratutiy

Dear Madam/ Sir,
MY Service period 06.11.2008 to 31.12.2013

probation period is 06.11.2008 to 06.11.2009, so they are telling on your probation there is no PF deduction so not eligible to consider ur propation period for gratutiy

But total i have completed 5yrs 2 months

Pls help me to get gratuity.

You are entitled for gratuity. If no PF was deducted, your employer has done an illegal act. You please write to the the PF commissioner of your state about this. For your Gratuity, please approach the Controlling Authority under the Payment of Gratuity Act, 1972.
