On being spotted an ad in the net, I ordered for a product (android tablet) online at ShopBigadda.com on 29/3/2012. I paid 100% advance for the product on the same day through Netbanking against which I have received the acknowledgement by mail from them. But in spite of series of my correspondences made with them through telephonic contact and e-mail, product has not delivered to me. Each time I am hearing lame excuses from the Customer Care like product is being shipped, product returned back finding no addressee, product got damaged in the transit, product is out of stock, etc. etc. Now, almost two months have elapsed, neither I am getting the product nor getting the refund of my money.
What is the legal remedy available either to get the product or refund of my hard earned money? Kindly enlightened me with various legal options available for quick redressal please.

First of all you should serve a legal notice to the company on th esite of which you have booked the order calling upon to delive the product and warn them that in case failure necessary legal action will be taken. Even if you did not get your product approah to consumer forum.

Dear Mr.Mukesh & all experts here,
Problem faced by Mr.Tage Talin is really a serious one & of grave concern.We all know that shopping on-line has alarmingly overtaken the general market.There may be some agencies entering con-business only & robbing off the hard earned money of many by lucarative assurances on-line.But where to prosecute the culprit is a matter of concern again apart from territorial jurisdiction and cause of action.The other taxing feature of this kind of transactions is that WHO has to be prosecuted 'a real person or a` juristic one'? Mopreover HOW to serve notice/sumnmmons?All need "GUIDELINES".
My request is to those expets who have expertise in CYBER LAWS may deliver their opinion so that more and more persons are benefited and saved from being dupte by such u8nscrupolous persons

My sincete thanks to Dev Kapoor Sir for strongly supporting my case. There may be many unlucky persons like me who have been cheated and duped by such unscrupolous persons hosting online shopping sites. We need learned expert like you to help wipe out such cheaters from the holy land of our motherland.. I look forward to joining more expert in crusade against such unscupolous online shopping sites.

Government and CYBER POLICE CELL are taking strict action on complaints lodged for cyber crime. As cyber crime are on increasing , more Police are trained to investigate. Unluckily, India have no equipments production for it, and depend upon only 3 supplier all over world with very high cost.
It will take time to check cyber criminal.
for the time being, be careful, be alert, and do not go in trap, do not become easy prey of cyber criminal. They act very very smart, almost impossible to catch them . Nigerians, on yatch, with latop, operates from foreign country on internet, go on changing mode of operendi and IP addresses.
