Open plot society maintenance

Open plot society was formed 4 years ago. Out of 200, 150 plots were sold to customers. Now these 150 plot owners are paying maintenance to society but the Developer is not paying maintenance for his 50 plots. All plots are using same facilities and road, light etc. Developer says as per law he is not supposed to pay maintenance. But he is not able to show any rule to us. What is legal stand?

where are you located? is the developer admitted as member? is property tax included in maintenance bill ?

is the builder paying bill for property tax?

NA tax for entire property is paid from maintenance amount for last 4 years. After follow up the developer has agreed to pay proportionate NA tax amount to the society. The chairman and secretary are the developers themselves. as they are promoters of the layout scheme.

once society is formed each member is required to pay maintenance . merely because developer has some unsold units does not mean that he can refuse to pay maintenace . the maintenance charged by society generally inclused property tax for various flats or plots . the other flat/plot owners cannot be called upon to pay property tax for plots owned by builder .

Yes what reason the 50 flats are yet to sell.
Those who are the members of society only need to pay the maintenance charges. Is any clause been made for the same .

It is open NA vacant plots society. No construction is made. Developer waiting for better rates. Maintenance is collected for security, water connection, street lights etc
