sir ,
i have to give one property opinion to bank whether this property is deserve to give loan or not ,
for that what are the documents i have scrutinise ,
is there any format to give legal opinion ,

the procedure from bank to bank differ. Bu the tracing of tile and opinion is one and the same
normally all the title , parental deed, encumbrance certificate, possession certificate, tax receipts, revenue register for the land, and on

it depends upon the policies of the bank and you can see all the relevant record of the property like the jamabandis, Mutation, Revenue receipts, share of the loanee etc.

You need to verify all title deeds & documents, regitrar's record. It is also advisable to give public notice and invite objections.

The standard format given by our learned friend is good. Mainly you have to verify all the relevant documents to confirm the devolvement of title to the mortgagor. Original of the primary document must be available for depositing, together with all the subsidiary documents. Encumbrance certificate for atleast 13 years to be taken and confirm 'Nil' encumbrance. As far as possible, third party mortgages should not be encouraged.(Property owner unrelated to the borrower.) Don't give any title clearance under the pressure of the banker. Send the legal scrutiny report in sealed cover directly to bank; don't send through the report and return of documents, through the borrower.
