the referrence case of various judgements of ncdrc ,consumer forum that states the application under order 9 rule 13 CPC is not maintainable in consumer forum

Yes it is not applicable and case once decided can not be restored except by National Commission.

The op filed one application under order 9 rule 13 CPC in district consumer forum to vacate the ex parte order passed by the ld forum following which several hearingaround 7 hearings were called for the above petitition by the LD forum but the op avoided the hearing consequently the petition was dismissed on the absence of op can op appeal regarding the same in state commission or the national commission
