Have you paid any amount in advance? If not and he has not accepted any money in advance, the vendor is not obliged to deliver the material. He can be compelled to deliver the material only if he has already accepted any amount in advance from you.

Vender can be compelled only in case when he has been paid for that material.you have not paid/advanced any amount to him so can not compelled.
Sailesh Kumar Shah (Expert) 08 November 2012
since you have no proof, then no legal action can be taken.
Rajeev Kumar (Expert) 08 November 2012
All the experts are right and there is no legal remedy left because the vendor have not entered into contract and for no consideration is paid.
