(Querist) 14 February 2014 This query is : Resolved
sir i have entered into an agreement/contact with regard to a flat.they are joint sellers(father, mother and son).
i have send them a letter for getting sale deed registered which has been pending for long.
i have received reply which has been only signed by son.
is it legally valid or there are some malafide intents of the sellers(joint sellers).
Devajyoti Barman (Expert) 14 February 2014
wHAT IS THE LETTER ALL ABOUT?
If they refuse to register then you can go to civil court by way of suit for specific performance of contract whereby they may be directed by court to complete the sale by way of execution and registration of the deed of sale.
Annu (Querist) 14 February 2014
sir letter is just about reminding them to perform their part of contract ie.complete the process of registration of Sale deed.
Rajendra K Goyal (Expert) 14 February 2014
You have not mentioned contents of reply from son.

In the given facts agree with the expert Devajyoti Barman ji.
Annu (Querist) 14 February 2014
son s reply pertains to the deposit of transormer charges, corpus fund ,maintenance etc..which are the matters of post registration of Sale deed.he is un necessarily lingering on the registration process.may be he is blackmailing me to extort some more money by delaying the process.
Rajendra K Goyal (Expert) 14 February 2014
Send legal notice to all for getting the sale deed registration process complete. Afterwards file suit for specific performance.
R.K Nanda (Expert) 14 February 2014
FILE SUIT FOR SPECIFIC PERFORMANCE IN CIVIL COURT.
Advocate. Arunagiri (Expert) 14 February 2014
You can file a case for specific performance in the city civil court?
Annu (Querist) 15 February 2014
sir i wanted to know if only 1 person responds out of 3 who collectively are joint sellers then is there some malafide intents of sellers behind this?
venkatesh Rao (Expert) 15 February 2014
Consult an advocate immediately because time is the essence of contract. I must say, query is incomplete.
T. Kalaiselvan, Advocate (Expert) 15 February 2014
I agree with Mr. Venkatesh Rao that the query is incomplete. Consult a lawyer and issue them a notice asking them to execute the sale deed and registere the same in your favorafter receiving the balance of sale of consideration amount from you on your expenses within the time specified or else you may go ahead with a suit for specific performanceof contract. The way they avoid to respond to your demands appears to some intentions malafide on their side.
Annu (Querist) 16 February 2014
sir is this a offence when instead of being joint sellers (who have collectively received entire consideration)only one person is turning up now.
