A vehicle was given to my clients (garage)for repairs on 15/07/2011. after inspection an estimate of Rs. 1.40 lacs was given to the customer which was approved by him. The necessary repairs were done and the vehicle was kept ready for delivery. The customer was informed about the ready status of the vehicle, he informed us that he will come in 2 to 3 days to take delivery of the vehicle but he never came to collect the said vehicle till date. My clients were constantly trying to contact the customer but he never used to pick up our phones, we have left messages on his mobile also but there was no response. The said customer thereafter became untraceable. later a complaint was filed with Police regarding the same but the police too could not trace him out.
Till date the vehicle is parked in the workshop premises
I would request the learned expets to give your views on what action can be taken by the garrage to dispose off the vehicle?
The address given by the customer is also not proper.
Kindly advise

issue legal notice at address mentioned by customer . if no reply received then issue advertisment in newspaper too as safety measure .
the problem is you cant sell the vehicle as you dont have the original papers and you need customer signature on documents to sell the vehicle .

its better to serve the party with a legal notice.
Since it is likely to damage with the passage of time, you may finally end up with selling the same in scrap.
or else you may also file a civil suit for recovery for the work done upon the vehicle.
