Paid advance cancelled agreement

Hi all,
I recently paid Rs.100000 for purchase of a flat which cost Rs.3500000 and it is under construction, for a token money we paid Rs.100000, due to ill health and other health conditions iam not in a position to purchase the house.

Went to the Construction company to recover the money, they are rejected to pay the token amount of Rs.100000. I told the construction company to deduct the processing fee and pay the balance amount.

My question is if i go to Consumer forum can i get the advance amount paid Rs.100000.

Please advice.

It depends upon the terms and conditions of the agreement. I Think you may not recover. It is better if you can send the scanned copy of the agreement.
