parents remarrying my wife

i am married to a girl and she is above 18 years of age.We both are hindus.but now she and her parents are denying the marriage.i have already lodged case under section 9 of HMA.BUT they have not taken my case seriously and her parents are again remarrying her.How can i stop her marriage?My marriage was not registered but it was done in a temple.i have got the priests certificate,2 witness,and marriage photograph.Please help.

If the girl is not ready for her second marriage. You may seek the help of police specially of women cell. she may file suit under DV Act against her parents. But if she is ready for second marriage you can complaint for bigamy against her in court.

(2) Coming to your point of grievance, I could feel that your wife has taken a decision to marry you and after marriage, she changed her decision voluntarily or by force through her parents. Since you have all evidences of your valid marriage, you can file a case in your City/Town District Court for joining her with you (Restitution of Conjugal Rights). You may talk to a local lawyer and get his service.

You may file Petition under section 9 of HMA and if she re-marry then you may file the case for bigamy and seek divorce also

you have already filed the restitution of conjugal rights under section 9 of HMA. file a urgent petition for take the petition on file for purpose of numbering with help of your lawyer. Give a complaint to Women police or protection officer regarding the second marriage. if marriage took place file a private complaint for bigamy.

you have already institutted proceedings u/s 9 HMA. File a complaint regarding fear of second marriage and thereafter approach the Court with the copy of police complaint seeking necessary action on your complaint. Incase the marriage takes place and you are able to prove the first marriage, the second marriage will not only be null and void but also will be a fit case for bigamy.

You can file a civil suit for injunction wherein you may file an application for temporary injunction making a prayer for restraining your wife and her parents from performing her marriage with someone else.

I agree with Praveen. Since the second marriage is illegal. You are advise to file civil suit for injunction restraining her from remarrying.
