Partition!

Dear Experts,

What is the meaning of 'PARTITION', between whom the partition is effected.Kindly eloborate the meanig of 'ORAL PARTITION', between whom the Oral partition is effected.

Can Oral partiton intrument is usefull for effecting transfer of ag-lands property from mother-in-law to Son-in-law?

Partition is a process to part with the joint share of the parties concerned which can take place only between the co-sharers.

Oral partition means such partition made without intervention of court/revenue officers and without entered in any record of State and the same can also be effected only between co-sharers of a joint property.

Can you tel me the meaning of useful so that I may be able to face your further query?

Possession can be delivered but the same shall not become part of revenue record.

Dear Sir,

In this particular case;
Mother-in-law is the owner of Agricultural lands & some other property. During her life time she had given a GPA to her Son-in-law to deal with the property. In her will she had not given him any of the property. But, some how he brought his name ( Mutated)in Revenue records in some Agricultural lands (Patta Lands). As on day the matter is in the District court .

My query to you is, can he take a plea of oral partition ( Ofcourse, his MIL had not mentioned any thing of this sort;but for a GPA which was given to him,in her Testament).

Please EXPERTS give me clarification in regards to this doubt!

No , partition is not possible and without registration no title passes.

SIL does not have any right title or interest MIL's properties by the said POA unless the POA is registered with right to transfer conferred and he has got properties registered in his name and there after has got mutated also.
