Partnership Act

(Querist) 30 October 2009 This query is : Resolved 
Father, his son and some third persons are running a registered Partnership Firm and thereafter his son became an Advocate as such he had retired from the firm and practicing as an Advocate. Now my doubt is, Sir, whether the son being an Advocate shall conduct the cases for his erstwhile partnership firm by filing his Vakalat?

Is there any bar under any law? Kindly advise me.

No there is no bar to plead any case of the partnership firm in which the advocate was also a partner prior to his enrollment as an advocate. No law debarring him doing so is available.

But at the same time, I have a doubt that the Advocate's Father is still engaging as a Partner in the said Partnership Firm.

So is there any bar?

Kindly clarify on this issue.

Kindly refer BCI Rules, there is no bar unless the advocate is himself a partner in the firm or he has any precuniary interest in the partnership firm.
