i m working in Airports authority of india. Last year i got apromotion & undergone 4 months training for the new post.i was given salary as per the new post. But now i got a letter for recovering pay,as they are saying that during training period i am not eligible for the new pay, i m only eligible for the pay of my old post. But as per R&P policy of central govt, i m eligible for new pay. pls help me,,,, let me know any judgement exists in this regard...

The question arises, were you promoted prior to your deputation to training, or you were sent for training from your previous post?

Even if the salary/pay for the training period was erroneously paid to you then also it cannot be recovered as you had not persuaded them to release wrongful salary for that period if you were not eligible for that.
You make representation against the notice, reply it properly with the help of some lawyer and thereafter go against the order of the department before CAT.

Judgement merely would not do. You have to approach the high court to redress your grievance.

It seems that amount is very little. I suggest you that return it because there may be more expensive in legal proceedings.
