suit filed for non payment of rent by tenant and ejectment in jan.2011 case is pending as defendent neither filed w/s nor appearing on various dates. case has come to stage of exparte evidence of plaintiff. my request for payment of arrears of rent is not considerd so far. though my lawyer has prepared details of arrears and submitted to court but court did not consider. at what stage court will ask tenant to deposit arrears of rent. rent of the period after filing of suitis also not paid. property is located ion amritsar punjab

The defendant is running the risk by not depositing the arrears as well as the running rent as and when it becomes due ,
you can submit these accounts while tendering evidence in your behalf for the suit , you are safe in this circumstances , it is for the defendant to worry and not for you , considering that the defendant may be in default , court may grant you a decree for eviction of the tenant andfor recovery of the arrears of rent found due

The execution for the possession and the arrears shall be made after decision of the present case because the tenant has become ex-parte so get the decision as soon as possible by deposing your entire evidence in one hearing.
