Payment of dues

(Querist) 03 April 2014 This query is : Resolved 
I left my last company almost 10 months Back and at the time of Leaving my salary for Total 25 Working Days was onhold with company

I was told the same will be Cleared in Full & Final Settlement .

After 5 Months of Leaving that company and after my repeated mails to company I was Given a Full & Final settlement letter ( Copy Attached ) by the company asking for my acceptance to take that settled Amount.

Which again was not paid even I was ready to take that amount.

Now the company has accepted the liability for Dues pending for Payments to me in written

Pl suggest
1. under which provisions of C P C I can file a Civil suit for Recovery

2. How to prove the Authenticity of that Mail Received by me which was send by the company using company domain for Full & final settlement
( which is now the accepted Liability )
Recovery Value : 45000/-

1. It is normal suit. No special provision under CPC.
2. E-mail id admissible in evidence.

[1] Generally suit is filed under order 7 rule 1 of C.P.C
[2] E-mail id or any electronic evidences are admissible u/s 65 A & B of Evidence Act.

I agree with the experts, firstly, send a mandatory demand notice to the company demanding your dues with interest till the date of settlement from the date it became due at the market rate or any other you reasonably suggest. If you do not get a reply or a proper reply complying with your demands, you may opt to file a money suit against the company for recovery of your due amount.
