Payment of gratuity

Thanks for the quick reply from the experts. But sirs, as the Payment of Gratuity act says that minimum 4yrs and 190days for the organisations having 5days a week(amounts to 260days a year) and 4yrs and 240 days for the organisations following a six days a week(amounts to 302 days per year) are eligible for gratuity. But under the RTE the minimum working days for the teachers is only 220days a year. Can I claim the gratuity as the no of workings days per week is around 4.2days. As in the first case the no of wds are 5 and the person is eligible for gratuity if he worked for 4yrs and 190day. Hence I had a doubt and belief that I am eligible for this claim..

First of all, you were required to post your supplementary post in the same thread, where you raised the original query and received replies.

Secondly, if you opened a fresh thread, your query is baseless without mention of the period of service rendered by you.

Thirdly, as you have stated that you had a doubt and belief that you were eligible for gratuity, please note, doubt and belief are two opposite notions and perceptions. If you have a belief, you should have applied for the gratuity and waited for the response before expressing any doubt. Your doubt would have been based only on the objection if any received from your employer.

There is no use of nurturing two opposite ideas without any problem having arisen so far.

So, your question would have been based only on the objection of the employer quoting any reason, if and when received .
