Payment of Gratuity to the teacher of private school

Whether a teacher who has been retired from the CBSC affiliated college in the year 1999 can get Payment of Gratuity with interest ? and for delay what to be done in filing application ?

I have not recieved till the information regarding coverage of teachers under PG Act.

Teachers are exempted from the provisions of PG Act, 1972. But the Govt. is bringing out amendments to include teachers under the coverage. Regarding the case of retirement in 1999 we will have to wait and see whether the amendment will have any retrospective effect for more than ten years.

In the given case, teacher of unaided private school is not entitled for the payment of gratuity as still it is under pipe to cover such teachers under this social legislation.

I disagree with all the opinions. Schools have been defined as establishment by the notification of Central Government in 1997.
Further teachers fall into the definition of employee under the Act. Therefore, they are entitled to get the gratuity.
