Pension benefits

My colleague retired from the bank on superannuation. A case is pending in the CBI court in Mumbai where he has been made accused. He is a pension optee. The bank is not releasing gratuity. Whether it is proper on the part of the bank to withhold the gratuity, when it is clearly said that gratuity can not be hold back under any circumstances as per gratuity act. Does pension regulation overrule gratuity act?
