Permission to start new business

If a person has been charge sheeted for running business for not taken legal permission, can he ask for the permission to start same business? Can the concerned authority legally deny him right of earning ?

Civic permission to start business has no concern with the pending prosecution.

If the authority is not permitting the licence after application,then what should be done?
Article 11.of human rights ,is it applicable here?
(1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.
(2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.

Your query is just an academic query. About what LEGAL permission for which business and by whom you want to ask? However, if in Government service, any private business or profession on the part of the employee is prohibited. So forget about permission by the departmental authorities.

This is regarding Bombay Nursing Home Registration Civil Surgeon has powers to grant it.I have applied 2 months back for new hospital registration and started it expecting it will be available soon. Now he has put case against me as I am
criminal (doctor in custody) Can I re-apply for registration as my basic right to earn for living.
