Personal appearance of accused durng appeal

Ld counsels,

Accused goes on appeal to session court to challenge his conviction, once after the suspension of sentence is it mandatory for accused to appear before the session court during all dates of appeal.

In an appeal, the convict is on bail, hence personal appearnace of appellant/ convict is complusory.

Yes, however his appearances can be waived on few dates.

The accused/appellant is not required to come in person on the hearing dates pending his appeal. There may be insistence of any particular appellate court for his appearance.

I agree with Mr.Rajkumar. During the appeal the he is not accused, he is only an appellant. So, his presence is not at all required. But, the court may seek attendance at the time of passing the final orders.
