PF & Labour Registration

One my friend is contractor by occupation. He has only one employee-Manager @Rs.5,000/- pm. And does not have any other regular employee, and gets his all work done by daily wage unskilled and semi skilled labourers. His master have asked him to compulsorily provide the Registration No of PF and Labour deptt, though he is not required to get the same. Please suggest the way out. Can he get PF and Labour without fitting in the crietaria? What would be his responsibility if he gets registered?

Your friend is laible under the Contract Labour( Abolition & Regularisation ) Act for P&F, ESI, Minimum Wages, Payment of Wages, Workmens Compensation, Leave, Holidays and compliance of other labour welfare legislations. The Principal employer, such as owner of building in your case, can deduct all dues to such workmen from the payments made over to you. Your friend has got to be registered as a contract labour suppliers and also under other labour welfare legislations. There is no way out there. Violations are penal in nature.
