Legally your employer is accurate in his approach as he is not duty bound to provide this facility for the employees already getting more than Rs. 6500/- in the head of basic wages, dearness allowance, retaining allowance and food concession, if any.

The rate of deduction and contribution for both the employee and employer is 12% at present.

Even if an employee was getting PF facilities with his previous employer but after his joining with new employer, the terms of new employer shall be counted and not of previous including EPF facility.
