PIL related inter district transfer in basic department

sir, how do i file a pil in high court of allahabad related inter district transfer of a married lady teacher to her husband's district who is also a employee in same department? is it possible through seesion court? what is the fee for a pil ? in what time, result of pil will come?

First You have to send your representation to the district employment and education officer.. If its no effect mean you can invoke the extra ordinary jurisdiction of your high court under article 226 of constitution of india. If court satisfied with your case mean its will pass necessary order or may direct the district employment officer to consider your representation..

You can't file it before district court. One more thing mr.yogendra pil mean its might be as public interested. Never try to it for private interest or publicity interest or paisa interest. Now a days high courts and supreme courts are very strict with this issues. If anything wrong mean court may impose heavy fine on you..

Greetings Mr.Prakash,

First of all, I would like you to kindly enlighten me as to which part of this issue is of public interest. If at all you have any grievance with a Government Department, you must make a representation to the concerned authorities, in this case to the District Education Officer and all other formal higher officials. This should do the job. If you don't get proper response for your representation, you may go for a Legal Notice and if it proves futile too, then you may go for a Writ before the Hon'ble High Court under Article 226 of Indian Constitution.

Kindly beware of the fact that if a PIL (PUBLIC INTEREST LITIGATION) is filed for personal grudge or to wreck vengeance, the Hon'ble Supreme Court and Hon'ble High Court may impose exuberant cost on you, most likely Rs.50,000/-

You will have to file a writ against the state govt., moreover wife can be transferred to the place where the husband is working or vice-versa

this matter does not involve any public interest so the PIL petition is not maintainable.

every govt. employee is governed by service rules as adopted by the concerned state govt., if there is some violation of rules in transferring or appointment of the employee then let the aggrieved employee file an appropriate representation with the concerned department prior to any litigation.

a third person has no locus standi to move any such petition before the court of law.

PIL will be solely against your interest, as it is your personal case. You may also making the authorities deadly against your wife due to any sort of litigation and may try to take some strict disciplinary action against her on one or the other fake grounds as you are staying in a state like UP.

Better, you may send your application as already suggested against two of your earlier questions.
