Plaintiff evidence

(Querist) 29 August 2018 This query is : Resolved
As the plaintiff doesn't have the land puchase deed and they have only house tax receipts and land certificate given by village sarpanch..They are now they are summiting affidavit of some people that the land belongs to him...The plaintiff also comes with some people for statement in the court that land owner is plaintiff..

The defendant has land purchase deed, land record certificate, and noc of all nominees duly notarized...

Do the plaintif win the case and proove the ownership by village people statement ?

Do the judge not allow stay order to defendant due to people statement and affidavit of those persons ??

Your expert advice is highly appreciated..

Thank you

How you are concerned with the facts regarding the suit property?
What is the opinion and advise of your lawyer?
Have you lost faith in your lawyer?
Why do you need obligation of experts on this platform for analyses and providing second opinion except the fact it is available FREE OF COST?

Any suggestion depends upon the pleadings in the plaint.

Such liars that pose as lawyers and indulge in unethical/unprofessional conduct are blot on profession.
If you have irrefutable evidences you have the option to proceed against such entities.

'Buyer Beware' applies to property deals.
It shall be appropriate to get proper legal opinion from a very able LOCAL senior counsel of unshakable repute and integrity specializing in revenue/property/civil/DRT matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt , before signing or making payment.
This may cost some FEE but can defend long term interest and hard earned monies.

Take help of elders of your family, competent and experienced well wishers, seasoned PIP’s, helpgroups, and find a very able LOCAL counsel of unshakable repute and integrity specializing in concerned field of law e.g; reveneu/Civil matters as in your case, and well versed with LOCAL applicable rules/personal laws, precedence, latest judgments etc …. and worth his/her salt, and your counsel can advise you after examining all docs, evidences on record ..
There are such very able counsels at each location.
Check for such counsels at LOCAL O/o Tehsildar/civil courts, HC, SC…
The ownership in case of ancestral property may be having narration in mutations records..
As per LOCAL revenue codes is village sarpanch empowered to issue said land certificate?
Is said land certificate equiavlaent of mutation records having narration of owners?
The tax receipts may not be necessarily be any valid document of ownership.
