Police complaint against owner by tenant

My grandfather (maternal)aged 84 owns a double storey house , he resides on ground floor and whereas his son on the first floor , father and son have no talking terms , father has disowned him five years back , and told the son to vacate the house but he is absconding from the house , he had illegally got installed the electricity meter on his name whereas he is not the owner of the house , which after his absconding the father got it cut and payed the bill as if noone pays the bill , its the liabilty of owner of house to pay , the father had put lock on the stairs so that he cant use the house as the son had locked his floor , now the son has put up a police complaint against the father that his father that stolen three handicams and jewellery from house and police came to arrest him , what is to be done in such a situation , the father had complained earlier against his disowned son but police took no action that the son is harrassing the father but when son complained police against father came in an hour , what should we do the police doesnt support .

police is bound to take action on complaint if the father had filed any complaint before that incident then he should send a complaint to higher authorities regarding non action of police

the police says its a family matter between father and son , we wont interfere or tel him to vacate or any other thing

whereas the police says as they have put a theft complaint against father and his caretaker we need to take action as its a criminal activity , but the same son is disowned , harrasing and abusing his father , not asking food or anythinh to 84 yr old that he has to keep a maid for cooking and lives all alone in the house .

If the complaint is treated as an FIR then the said father should get anticipatory bail from District or High Court. On the other hand if the complaint is false then he can file a Quashing Petition in High Court or he can file a Writ Petition in High Court for over action of Police Authority.

sir at present they are going for a compromise with reconnection of their electricity and the so called stolen handycams , as in this age he cant run around , so with the pressure of police unwillingly he opted for compromise ,it is state of U.P where people like durga shakti nagpal are also suspended what is my grandfather, but in a situation like this what complaint should the father put in police against son , that they actually take action , he is right on his part , the son is disowned but still he is the one suffering .what complaint should he put as i have described the whole situation and what to do , if stil police doesnt take action

If any compromise is got done through police take a copy of the same. In continuation of the old complaint he should write to higher Authorities if the old complaint is not a part of present compromise otherwise may file fresh complaint after some time. He should gift the unauthorized occupied portion to some other near relative if it is self acquired property. He should file a case of maintenance in the court.

and recently he(son) got the electricity connection installed , even though he is disowned and not the owner of the house , as installation of electricity connection requires consent of owner of the house, what to do ?

Till now you have not told whether the property is self-acquired or inherited? As you rightly pointed out that at this age running pillar to post is difficult, I advise that once compromise is accepted, forget and live peacefully without caring the behaviour of the son. If the father starts ignoring the son and show love and affection on all related including the son, the boy will realize his mistake.

it is a self bought or self acquired property by my grand father from his own money . and compromise is not possible as the son has done such deeds which are unforgivable.

If it is self acquired property, he may gift the forcibly acquired portion to some other relative who can proceed to get it vacated.
