pc granted to cbi by the cbi court in rajasthan whether cbi offical can take accused out of rajasthan for interrogatin without transit permission or without specific permission of court? case law with answer will be appriciated.

Any investigating agency during the period of remand can take the accused with it at any place without specific permission of the court as this is part of investigation.

Remand of an Accused is granted to the Investigating Agency by the Court for completing investigation and investigation includes interrogation, recovery etc. It is not necessary that the investigation should be completed within the local jurisdiction of the court which has granted remand. Law requires that the accused must be produced before the court on or before the end of the remand for necessary orders/directions. So there is no illegality in taking away of the accused by the IO beyond the local jurisdiction of the court which has granted remand. Th action of CBI is legally correct.
