Police wont take my complaint without legal documents

(Querist) 14 June 2011 This query is : Resolved
Sir,
We have an old house which is shared for my 3 brothers. It is registered in my father's name. He is no more now. One of my brother demolished our shared house without getting consent from me. For that I went to police station and file a case against the demolishing activity. But Inspector asked that I have to submit xerox copy of registration bond for our house and proof of legal heir during complaint given. Otherwise he wont accept it and file a case.

Suppose, in my house, if there was any theft, that time I have to submit legal documents for home, jewels and thief photos too to police station when I give complaint. I think, police station expecting like this in my case.

This kind of police activity is right way? Can I approach other police officials?

police is just avoiding to take your complaint. file a complaint with his superiors like District Superintendent or DCP as the case may be. But at any rate you will have to file a suit for partition and separate possession of your property coupled with damages towards demolition of house.

The issue is not similar to theft. One of the sharers has done something without the consent of other sharers. Police would be justified to interfere in such matters only on seeing proper documents. Better you approach civil court for partition and separate possession of the property.
