Posession of land

(Querist) 03 July 2014 This query is : Resolved 
Dear Sir,

i have a sale deed which has been made in 1951.But my father & grandfather by that time could not make the ROR .AND the original ROR could not changed , and remain same with the person who sold that land in 1951. We have possessed that that land from 1951 to 2014 that is 64 years. But now the sons of the seller who hold that land claims to withdraw the possession and handed over the land to them. Can it be possible. Can I file a suit against him , and can I make anthor ROR on the basis of the sale deed made on 1951.

If you are still in possession then nothing to worry.
Yes you an apply for change in ROR even now on the basis of land deed.

Since ROR is not changed in the purchasers' name the legal heirs are making claim. But since the possession is with you, you can apply for mutation now.

Revenue records are not absolute as to title to property. You have the tile by virtue of the sale deed and continued possession of there after.

You may approach the concerned authority ofr effecting changes in the RoR.

I agree t the views of expert Mr. P. Venu on the subject issue. The seller's successors cannot claim a right over the property merely because the name was not transferred on the buyer's name till date. You can apply for mutation of records even now on the basis of sale deed.
